1753   The Maryland State Archives Vol. 17 No.11, Roads in Frederick County, 1748-1765 ,by Pat Melville – Sometimes, the opening of a new road caused more problems than it solved. At the November 1753 session, Richard Cooke, who was renting a plantation formerly possessed by Stephen Julian, cited a new road cleared through the upper part of his land that destroyed one entire field. He wanted the old road restored because it went over level ground, whereas the new one was “one entire hill and full of grubs”. The petition was granted. A year later, John Smith sought permission to change the route of the road on the west side of Antietam Ford where it had deep ruts and was subject to flooding by runoff from the surrounding hills. The court authorized him to make the alterations.

The American colonies were organized into military defense districts, for no regular army existed to protect settlers from marauders or from rebellion within. On alarm, colonists formed militia companies from their own ranks to go to the scene of action. When the emergency ended, these trained bands retired. The Grand Jury was made up of Nicholas Haymond. foreman, Abraham Lakin, Daniel McCoy, Edward Boteler, John Brunmer, Jacob Sturrum, Ephraim Davis, William Burgess, Henry Clagett, John Kimbol, William Beatty, Charles Springer, Mathias Ringer, John Harlin, Elias DeLashmutt, Stephen Julian and Allen Bowie. The Rev. Mr. Thomas Bacon states in a petition to the Court that “a certain John Brown, laborer, a free mulatto,” bound himself on the 11th on January 1764 to Bacon’s service, but about May 1st Brown ran away and was gone until the beginning of January 1765. He further states that as a result of Brown’s absence he was “under many difficulties and was obliged to hire hands at extraordinary rates.” Brown returned but was immediately seized with smallpox and “was supported by your petitioner and used with great tenderness notwithstanding which he ran away a second time on the 26th of February, 1765. He was brought home two days after but behaving very ill and attempting to run away again. Your petitioner secured him in jayl, where he now lies until the Court should judge concerning him.” The Court orders the Brown serve his master one year from this time in satisfaction of his runaway time.

The mystery thickens with the sudden appearance of William HEDGES whose relationship to the first Joseph HEDGES has not been determined. William wrote in his will on 11 Aug 1742 and died relatively young, before its probate on 29 Jan 1743. Calling himself a farmer of Prince George’s Co, he provided that his wife Ann should “live on my estate during life of my son, Joseph”, who was to get all the land unless an expected posthumous 4th child was a son, in which case the 2 sons were to divide the land equally. Ann was to serve as executrix. Robert JONES, Robert BAKER and Jacob NEFF witnessed the will, but only Robert BAKER was present for its probate.33 Co-sureties on Ann’s bond were Charles HEDGES and Filip KINSS.34 The inventory of 6 Mar 1743 made by John MIDDAH and Robert JONES was signed by a single creditor, Jacob NEFF, and by kin Charles, Joseph and Andrew HEDGES.36 In none of these documents is the land named or otherwise identified. But there are clues to help. Stephen JULIEN became Ann HEDGES’ 2nd husband on 14 Jul 1743 and together they prepared the estate accounts. In the account of 12 Jun 1747 they took credit for a payment to Jacob NEFF on a debt owed by William HEDGES but paid by Stephen JULIEN on bond of 22/5/6 plus interest.37 The posthumous child referred to above did turn out to be a son, WIlliam HEDGES Jr and because he was born in late 1742 should have expected to inherit his father’s land when he reached majority in 1763. By then Jacob NEFF had died. But our attention is directed to a deed dated 15 Mar 1763 from his son, Jacob KNEFF, heir at law to Jacob KNEFF of Prince George’s Co, deceased which transferred to Joseph and William HEDGES, sons and heirs of William HEDGES of Prince George’s Co, a 258 acre parcel called “Hedge Hogg”.38 Whatever his origins and whatever his relationship to the other HEDGES who preceded him, William HEDGES, sometime between 1740 and 1742 had begun purchasing “Hedge Hogg” from Jacob NEFF. But Jacob had died before the transaction could be concluded and it took until the youngest son reached majority for title finally to be established. As proof of the pudding, it will be noted that Stephen JULIEN paid taxes on “Hedge Hogg” from 1753 to 1773 and early in that period was shown as “in possession”.39 In 1772 Joseph and William HEDGES divided “Hedge Hogg” between them.40 5 years later they both died and their wills were probated on the same day, 6 May 1777. Again there were heirs who had not yet reached majority. But the land remained in the HEDGES family well into the next century. The 1873 Atlas, for example, shows the home of Eneas HEDGES (1800-1873) still on “Hedge Hogg”.41

Then occurred St Bartholomew’s Massacre – 2,000 in Paris and 20,000 in France were killed in 8 days…. Henry IV went to the throne in 1589 and in conciliation he joined the Catholic Church and 9 years later he issued the Edict of Nantes which gave Protestants freedom in France. In 1610 Henry died leaving the Protestants defenseless. Cardinals RICHELIEU and MARAZIN, particularly the latter, until his death in 1651 were influential in partially restraining the persecution. But on accession of Louis XIV all energies were directed toward the extermination of the heretics. In 1685 the Edict of Nantes was revoked. About 500,000 fled; 50,000 to London, others to Holland, Brazil, and America. They settled in FL, NY, MA, RI, and VA, but mainly in SC. La Rochelle France was for many years the stronghold of the Protestants in France.

1744   “Frederick Co VA Settlement and Some first Families of Back Creek Valley 1730-1830” by Wilma KERNS pub 1995 by Gateway Press Baltimore MD Chap 5 pg104 JULIAN family – JULIAN became a first family of Back Creek Valley when a father and his sons settled near present day Gainesboro. Patriarch Rene JULIAN was allegedly born about 1660 in France. After the Edict of Nantes was revoked by Louis XIV in 1685, he went to Holland for a brief period, and then to England. He fought in the Battle of Boyne River in Ireland in July 1690 and was granted land beyond the Mississippi (River) by King William III of England. Family tradition says that he sought to claim his land in America during the 1690s, but first stopped in Bermuda where he married Mary BULLOCK, dau of a sea captain Stephen BULLOCK. Rene and wife immigrated to SC in 1700 where they lived until about 1716. Two infants died in SC and they moved to Bohemia Manor in Cecil Co MD. When they heard about land openings west of the Blue Ridge Mtns they joined other pioneers who migrated to old Orange Co VA about 1736 or 1737. Rene and 4 sons settled near Gainesboro above the fork of Back Creek and Hoge’s Creek. Rene died abt 1745 which was 4 yrs before the Fairfax surveyors developed the plans for first settlers on Frederick Co VA lands. Therefore, Rene JULIAN Sr did not receive a Fairfax grant. An entry in Frederick Co Court Order Bk 1 on 12 Oct 1744 contains a petition that Rene be declared levy free or waived from paying taxes because he is “Aged and infirm and an Object of Charity.”  Tradition says that Rene was affiliated with the Presbyterian Church and that he was buried in the Opequon Presby Cem at Kernstown. A grave marker was noted in the 1940s and is not there today…

1771   Peter JULIEN was on committee of Regulators in Rowan Co NC at Salisbury protesting excessive marriage fees. Peter, wife Mary, and Peter Jr JULIEN were Regulators from Orange Co (Guilford) NC per what? The Regulators were an organization of small farmers is West NC protesting unjust taxation and extortion by oppressive local government. Peter JULIAN Sr signed several petitions to the governor of NC as a Regulator. A battle occurred on 16 May 1771 between the Regulators and Governor William Tryon’s Militia. The Regulators were defeated. Settlers were required to sign an Oath of Allegiance to the King of England or have their lands confiscated. Many signed the Oath and hundreds moved their families further west out of reach of Tryon’s militia.

He often lived in the village. He finally killed himself where the old road leading through Chancellor JOHNSON’s possessions by Frank ADKINS’ old place into the Charleston road, near Esquire McCALLA’s residence turned off the Columbia The fatal deed was performed by hitching the trigger of a shotgun on the limb of a bush and holding the gun to his breast and pulling it forward. Pg? – SC Memorials Registration of land grants by Mrs Jerome BAKER 1946 pg 7 Memorial exhibited by George JULIAN to be registered in Auditor General’s office – 300 acres Mecklenburg Co NC as supposed run out and in the Province of NC on King’s Creek that turns into Broad River. Originally granted 30 Aug 1753 to Thomas REYNOLDS – conveyed or otherwise became the property of William REYNOLDS and wife Hannah who conveyed tract by lease or sale to George JULIAN. By late resurvey that 300 acres falls within the Province of Craven Co SC on 30 Nov 1772.

George JULIAN first purchased land in Mecklenburg Co NC 0n 7 June 1766, 300 acres “on Kings Creek that turns into the Broad River’–1766 deed was witnessed by Matthew FLOYD (father of Abraham FLOYD).  Bothe George JULIAN & Matthew FLOYD signed the petition to the king concerning moving of the boundary line between SC & NC, indicating they lived in that area.  Also signed by Hugh QUINN.  In this general period – Abraham FLOYD married Eve JULIAN before Oct 1778, suggesting that Eve JULIAN was in this group of JULIANS, but father unknown.  In about 1778 Samuel JULIAN turns up in the vicinity of land deal regarding 200 acres on both sides of Bufflo Creek–then Tryon Co NC.  Was he a son of George JULIAN and brother of  Jacob?

At the time of its formation, Tryon County included a large area in what is
today North and South Carolina. Among the modern counties included in whole or in part in the territory of old Tryon Co are the North Carolina Cos of Lincoln, Gaston, Cleveland, Rutherford, Henderson, Polk, Burke, McDowell, and the South Carolina Counties of York, Chester, Union, Cherokee, Spartanburg,
Greenville, Laurens, and Newberry. The first county seat of Tryon County was
located in what is now York County, South Carolina. In 1772 a Royal Commission surveyed the border between North and South Carolina. The parts of Tryon County south of the new official border were allocated to South
Carolina “Districts” known as the Craven, Berkely, Camden, and Ninety Six
Districts. (In 1786, York County, South Carolina, was formed.

The official survey of the border between North and South Carolina created
great uncertainty among landowners in the area determined to be in the Province
of South Carolina, since their titles were based on Land Patents from the Royal
Governor of North Carolina. In 1775 these landholders presented a Petition to
King’s Council in London to have their land grants reaffirmed. Around 1788 a court case was brought against Abraham FLOYD regarding sale of land and Hugh QUINN was garnishee.  Abraham wanted bond paid to his mother-in-law Catherine JULIAN.

1782   The ‘affair of George Julian, of York County SC, his son Jacob, and the
consequences of being a Tory in Revolutionary Carolina. This story is pieced together from items in The Rebecca Downey White (RDW) Collection, housed in the Maryland State Archives, Annapolis; and various archival records in The South Carolina Department of Archives and History, in Columbia. Interest in the story resides not only in various Julian family historians, but in professional archival historians as well- for a rather strange reason that will become evident later.
The story begins in 1782 with the publication of a list of persons whose property had been confiscated by the Confiscation Acts of The General Assembly in early 1782. Specifically, George Julian is listed as “…an obnoxious person…” and his estate confiscated in Josiah Smith’s Diary of 1780-1781. The entire Diary is published in The South Carolina Magazine of History and Genealogy over a series of five issues in 1933-34.  George’s entry is in Volume 34, No. 4. The property was acquired by George in December of 1772. The actual confiscation is recorded in a Plat dated 19th May 1785, with the inscription “So Carolina, I have surveyed a tract of land on Kings Creek in Camden District Containing two hundred and four acres.
Late the property of George JULIN- & confiscated by Act of Assemble- this tract Contains a large Quantity of low Grounds. A small apple orchard – but the high land not very good.- Certify’d 19th May 1785. /s/ J O Palmer. DS.” A plat shows the property to be literally on Kings Creek. Today that property is in York Co SC near the Kings Mountain National Military Park. We do not know the background of the confiscation- obviously George was a Tory sympathizer and may have been of strong and public persuasion. Given the turmoil of the early 1780s in the Carolinas it would not be surprising to find that he differed from his near relations in their political views.
The Julian family group in Randolph Co NC seems to have been apolitical-
at least there is no record of any activity of that sort during the period. However, Colonel Bratton, a famous patriot, recorded the names of those he considered as Tories in 1783. His list includes ” Peeter JULAND, Peeter JULAND, Jr., Wm JULAND, Benjamin JULAND, Jary (Jesse?) JULAND..” and perhaps significantly, ” Daniel PONDER”.  As far as can be established at present, Peter and Peter, Jr. were founder Rene’s son and grandson, while William and ‘Jary = Jesse (?) were likely Peter Jr.’s sons. This group was located in nearby Newberry County. The evidence is somewhat circumstantial, but it is thought that these descendants were either Quakers, or had Quaker sympathies, leading Col. Bratton to label them as Tories. That the sons and grandsons of Rene and Mary had divided loyalties during the conflict seems assured: not that that circumstance was at all unusual during those tumultuous times.

Next in sequence is a petition by Jacob JULIAN submitted to the Speaker and House of Representatives of the State of South Carolina asking that his father’s land be restored. The wording is as follows: “That whereas by an act of Assembly passed at Jacksonborough in Feby or March AD 1782 the estate of George JULIAN was confiscated for public uses, and whereas the said George Julian was Dead At the time of passing Said act, and Your Petitioner, (heir at Law to Said Estate) as early as the year One thousand Seven hundred and Seventy Seven, had Voluntarily Banished himself from the Society of his relations into Mecklinburg County in North Carolina, in order to avoid being a witness to the pernicious measures in which they were engaged, and hath ever Since behaved himself as a Good Citizen- Your petitioner therefore humbly prays that his hereditary right may be restored to him & your Petitioner  as is duty bound will ever pray…..”  There is some lovely language here as well as some insight into the extent to which the struggle for loyalty divided families. And it might be of some historical note that the petition and its subsequent treatment was in the
State House of Representatives and not in the Courts. The fate of the Petition is recorded in the State Records of South Carolina: Journals of the House of Representatives, January-March, 1785 and November-December 1792. The record indicates that the purchaser of the estate at auction was one John MOFFETT. The House did decide in favor of Jacob and his father’s land was restored to him- John MOFETT then petitioned to recover his cost of  L510 Sterling. The House noted that the facts stated in Jacob’s petition appeared to be true without, however, explicitly acknowledging  the fact of George’s death before the confiscation- an important point as this is where the significance of the Jemima PONDER affidavit impacts the story. There is a bit of mystery surrounding this document. There is in the RDW Collection in the Maryland Archives a photostat of this document. The writing is in part faint and generally difficult to read. A transcript, with this in mind, is : “State of South Carolina Camden District [————-??] Came Jemima PONDER Before me for the Peace of the State and District aforesaid and [—-] being Duly sworn as the Law Directs Deposith and Saith that She did Live some time at the [bree—-} Meeting
house below D[-]caster and that George JULIN who Did Live on Mingo Creek in the District aforesaid was there and She the said Deponent did see the said
George JULIN Depart this Life Between the first and midday  of September in the year 1781. Her   mark      X Sworn to and Subscribed before me          Jemima + PONDER
this 12th of January 1782.

There are a host of questions raised by this document. Without doubt Jacob needed some sort of proof of his father’s death, particularly the date.
Perhaps we are permitted to wonder at the happenstance of a witness in so convenient a time and location. (Note also that PONDER seemed to be a
surname known to the Julian family.) I encountered Mr. Marion CHANDLER in the Columbia SC Archives, while asking for the Jemima PONDER affidavit  To my surprise he personally knew the story- or at least most of it- but did not know the whereabouts of that item. He said he had been looking for it for years and had not been able to locate it. As I knew that at least a photocopy was in the RDW Collection and it had been marked ‘The South Carolina Historical Society’ that perhaps its origin was indeed in Columbia. If so, at present no one seems to know.
Finally, who was this ‘obnoxious’ George JULIAN? From dated land records in the Kings Creek region for both a George and Jacob; and from Jacob’s will
probated in York Co. SC in 1800; and from consideration of the estimated ages of father and son; it is nearly certain that this George was the son of founder Rene and Mary (Bullock), and Jacob a grandson. Not all Julian researchers agree with this, pointing out that there is, perhaps, confusion between George, pere, and George, fils. There are adequate records for the existence of the latter; but his parentage, while likely the former, has not been established. P.S.
